What is a probate sale?

A home must be sold by PROBATE if the owner(s) on title passed away intestate. When someone passes away intestate, they’ve left their assets, in this case a property, without a written will providing further instruction on what can and should be done with them. Without specifying what you’d like to be done with your property (ie. who takes ownership upon your death, who can sell it, etc) the court is left to determine what is the best course of action for your estate. Through a process called probate, the court will assign a lawyer (Or your loved ones may choose their own), and proceed to make it’s best judgement on how to divide your property after having contacted as many heirs as possible. This can be a lengthy process and might not reflect the most ideal outcome for those close to the deceased.

What is a trust and how can it help?

In the great state of California, a will often is not enough to avoid probate court. For this reason, many place their homes in a trust. In part, a trust is a fiduciary arrangement that allows a third party, or trustee, to hold assets on behalf of a beneficiary or beneficiaries. Tax breaks can also be of benefit as a result of leaving a trust. A trust documents the trustor’s desires for their property upon death. In order for your home to avoid probate, you will need to have it transferred to your trust.

There are circumstances that can hinder a trust and cause the home to be partially or fully probated. Each circumstance is unique and can be discussed when we meet to list the property.
